Why protection language creates confusion

Broker websites compress complex legal arrangements into short phrases. “Funds are segregated” may describe account handling but not an insolvency payout. “Negative balance protection” may apply only to eligible retail clients. “Regulated” may be true for one group company while the visitor is onboarding with another.

The solution is not to dismiss every claim. It is to identify what risk the claim addresses, who makes it and where the obligation is documented.

The seven-check framework

Each check should produce a document, register entry or account-specific answer. If it produces only marketing copy, the verification is incomplete.

  • Entity: record the full company name in the client agreement.
  • Register: confirm that company and domain with the stated regulator.
  • Product: check whether the licence covers the service being offered.
  • Client money: read how and where funds are held.
  • Balance protection: identify eligibility and exclusions.
  • Compensation and complaints: confirm the applicable scheme and escalation route.
  • Change monitoring: repeat the checks after a domain, entity or terms update.
